Dear Melanie,

The very same culprits who passed Prop. 8 are now flooding the Governor with calls to block the Marriage Recognition and Family Protection Act. Co-sponsored by our colleagues at Equality California and Sen. Mark Leno, SB 54, the Marriage Recognition and Family Protection Act, clarifies where marriages of same-sex couples performed in other states and countries stand in California.

The Marriage Recognition and Family Protection Act will affirm that California will continue to recognize the marriages of couples who married outside the state prior to the passage of Prop. 8—and that those who marry out-of-state in the future won’t be treated as complete legal strangers in California.

Opponents of marriage equality claim are once again using lies and scare tactics to deny us equality. We must not let them win. Put an end to their campaign of lies! Enough is enough. Call the Governor today to set the facts straight. Let him know of your support for the Marriage Recognition and Family Protection Act.

The passage of Proposition 8 created a confusing and unequal situation that has left same-sex couples who married outside the state confused about their rights. More often than not, these include having to leave the United States in order to be with the person they love. These American citizens are forced to give up careers, leave behind
aging parents and young adult children who rely on them and leave a community which benefits from their ongoing and active participation.

The Uniting American Families Act simply seeks to provide gay and lesbian U.S. citizens and permanent residents the right to sponsor their permanent partners for immigration.  It includes the same process and penalties as applied in heterosexual sponsorship applications. By co-sponsoring the UAFA you are showing your dedication to equality and the belief that no American should be forced to choose between their country and the person they love.

THE AFTERMATH OF SHIRLEY’S BILL – AND UAFA:

Melanie Nathan Reflection: Before I approached Senator Feinstein’s office on behalf of Shirley Tan,  I realized that this was the case that would blow UAFA wide open and it was this, inter alia, that had me chose Senator Feinstein’s office above Senator Boxer’s; even though overtly Senator Boxer seemed more pro – gay, having co-signed on to UAFA.  Even though Senator Boxer’s office had first been approached by the family, I convinced the family and the organizations that Sen. Feinstein was the best bet, for a number of reasons.  The Senator’s position with the judiciary committee, her amazingly compassionate and receptive staffers, certainly went a long way too.   That said, I had no idea just how profound such a private bill could turn out to be.  I feel so thankful for having had this amazing experience and opportunity to serve my community in this way and I thank Shirley and Jay for placing their trust in s stranger.

 Part of my thinking was that here was unique case with such a high degree of humanity and compassion attached to it (and that is stated not to exclude the other approximately 36,000 bi-nationals in pain) that I would be perfect to “marry,” if you will, the humanity aspect and the same-sex relationship/family aspect; and in keeping with this intended pun, it turned out to be “a marriage made in heaven!”

 Once the decision, many of the organizations called in their support to the Senator and the were eloquently quoted in the media – especially IMMIGRATION EQUALITY’S, Rachel Tiven Julie Kruse and Victoria Neilsen; LOVE EXILE’s Martha Mcdevitt-Pugh, an exiled US citizen fighting so courageously for UAFA and living abroad with her beloved wife; and notably   GLAAD’s Cindi Creaver provided media assistance with OUT4IMMIGRATION providing amazing contacts.  Molly Mackay our marriage equality hero made the initial connect between me and the Tan –Mercado family.   (Please see the fabulous Article by my guest writer, Marion Mulder, of the Netherlands, which is posted on this BLOG)

 I AM attaching some letters and press releases to this Article to provide a collective forum for as much of the positive fall out and feed back as possible to highlight what has been accomplished and the amazing level of support for bi-national couples and our beloved brothers and sisters forced into exile.

LOS ANGELES — On Wednesday, April 22, 2009, facing threat of deportation, Shirley Constantino Tan, a native of the Philippines, received relief when Senator Dianne Feinstein and Rep. Jackie Speier introduced a private bill (S. 867) to allow Tan to stay in the US with her U.S. citizen partner, Jay Mercado, and their twin sons. 

“Shirley Tan’s case is a testament to the discrimination that exists within the immigration system,” said Sara Sadhwani, immigrant rights project director at APALC. Because same-sex marriage is not recognized by the federal government, same-sex binational couples are unable to sponsor spouses within the immigration system. “This case highlights the need for Congress to pass the Uniting American Families Act, which would expand the definition of families to include same-sex partners.”

“Family unity is an essential value to the Asian American community as well as for the immigration system,” said Karin Wang, Vice President of Programs at APALC.  “It would be tragic for Shirley Tan to be separated from her partner of 23 years or from their 12-year old twin sons, simply because of her sexual orientation.”

 APALC is urging Senator Feinstein and the entire California Congressional Delegation to support the Uniting American Families Act, which would allow US Citizens and legal permanent residents to sponsor their same-sex partners for immigration. Update Shirley Tan Deportation- out of options

On April 10th, Shirley Tan received good news and bad news on her rollercoaster ride to or from permanence in the USA.  Shirley received notice from the BIA that a deportation order was re-issued giving her 30 days to voluntarily leave the USA.  The good news is the admittance that the prior order was not properly served, thereby endorsing Shirley’s claim that she knew nothing about it.  This ‘cleanses’ her status, if you will, as she is now not out of compliance as had been painted by her detention. 

The bad news is that she is out of options.   Her application to BIA  has been turned down and she is ordered to leave.  There is no legal procedure to assist her in her desire to remain in the US with her wife and American children. The only way she can stay would be through extraordinary measures.  If you support Shirley and her family, please feel free to e-mail Melanie Nathan at nathan@privatecourts.com to express your support.  Cards can be sent to Tan-Mercado c/o Melanie Nathan, Private Courts, 1100 Larkspur Landing Circle, Ste 112, Larkspur, CA 94939.

 The right to sponsor Ms Tan has been cruelly denied Ms. Mercado throughout their long relationship.  Like some 36,000 binational couples in the U.S. and around the world, had they been in a heterosexual marriage, Ms. Mercado would have sponsored her spouse for permanent residency long ago.  However, because all Federal law is written in a way that explicitly excludes same-sex couples from enjoying 1,138 benefits of marriage, Ms. Mercado and Ms. Tan have not been able to enjoy one of these benefits, and have had unfair and unequal treatment under the law as a result.  Should Ms. Tan ultimately find herself deported, her family will have to make the difficult decision of whether to stay in the U.S., the children no longer able to be with their own mother, or to leave behind the only life they have known.

Instead, they fear being torn apart because the heads of their household are two people of the same gender.   “Passage of the Uniting American Families Act by Congress has got to happen sooner, not later,” said Waddling, “so that good, hardworking American families like the Tan-Mercados are not criminalized simply because their household is headed by two people of the same gender.”  The family’s representative, Melanie Nathan, said, “The fight is still on and we should not let our guard down, but right now, we owe a very special thanks to Rep Jackie Speier and her extraordinary staff.”

We also urge voters to contact their representatives in Washington to urge them to not only support the Uniting American Families Act, but to push for hearings on it this calendar year, to ensure that no more Americans have to choose between their country and their partners.

IMMIGRATION RIGHTS IN THE USA -
Why should our Children Suffer? by Melanie Nathan - breaking news…
Shirley Tan will be deported on April 3rd 2009.   The only way she can stay in the country is if a private bill is passed by congress or her case is adjudicated to be reopened, the latter which may not happen in time to prevent the deportation.

She is terrified. With her deportation imminent the offices of Congresswoman Jackie Speier and Senators Feinstein and Boxer have been notified with letters begging for their assistance.

The Department of Homeland Security, cannot grant an ‘emergency stay of deportation’ until Shirley is back in custody on 4/3, and within hours of being deported back to Philippines.  Only then can her attorney request an emergency stay. Apparently having a date a week ahead and a monitoring device is not enough to constitute an emergency – you have to be in custody…. typical of the rigidity of Immigration laws.

To stay in the US with her children and her partner, Tan needs her case re-opened because it was botched by an attorney, causing her to go out of her legal status.  She had no idea that this happened because the attorney tried to cover up the mistake. ( By the way – interesting fact – Proof of the fact that they had no idea there was a deportation order out is they were cleared by the White House for a visit which they did.  I can e-mail a picture of them with Sen. Boxer when they made the visit. They can give you these details directly.)

  2. We are soooo excited and feel sooo relieved and grateful!!! On May 3rd at 8 PM, our radio show, Living Proof on KRCB FM, will air our interview with Shirley, Jay and their boys. At the time of the interview (April 15th) we did not know of glorious outcome, of course. However, the interview explores how Jay and Shirley met, how they got pregnant with their fantastic boys, that horrible day in January, 2009, and their plea for help.
